Online Privacy Policy for Morphis.org

Special Notice to Children

Kargo, Inc. ("Kargo")'s web site, www.morphis.org (the "Morphis site") is intended for adult or adult-supervised use. Before giving any personal or registration information to Kargo in order to participate in any of the Morphis site's mailing lists or forums, use the bug tracking tool, or use any other of Kargo's other services, please ask your parents for permission. We encourage parents to actively participate in their children's use of the Internet. Under no circumstances are children aged 13 or under permitted to register or submit personal information.

By accessing or using the Morphis site, you agree to the terms of the Online Privacy Policy for Morphis.org, as outlined below. If you do not agree to these terms, please do not access or use this site. Kargo reserves the right to change the Online Privacy Policy from time to time at its sole discretion. Your use of this site will be subject to the most current version of the Online Privacy Policy at the time of such use.

Kargo respects its Users' right to privacy and understands that Morphis site Users need to be in control of their personal information. Kargo also wants to make information available on the Morphis site that is tailored to the needs of its Users. For this reason, Kargo may ask its Users to register when they visit certain areas of Morphis site, download free software, subscribe to a mailing list, report a bug, or make use of the community services/resources. Kargo may use the information its Users provide to:

  • Tailor the content, services, and advertising that Kargo places on the Morphis site and related sites to its Users' current and future needs.
  • Alert Users to product upgrades, special offers, updated information, and new services.

Automatic Information

It is Kargo's intent to develop the MORPHIS™ application in an open environment. As such, visitors to the Morphis site should be able to visit most parts of the site without disclosing any personal information. However, Kargo will log the visits of all Users to the Morphis site in order to track the actions and origins of our visitors. Logging may result in the collection of information about Users including, but not limited to, the sites from which Users arrive at the Morphis site, the Internet addresses from which Users view the Morphis site, and the content on the Morphis site that a User views.

Cookies

A cookie is a piece of data that a website stores on your local hard drive. Websites frequently use cookies to better serve visitors, i.e., by remembering passwords and personalization information and in order to gear advertisements. Kargo makes an active effort to limit the use of cookies on its Morphis site, but occasionally finds it necessary to use them in order to provide Users with a persistent state for visiting the Morphis site. Therefore, Kargo may use cookies to provide its bug-tracking system, administering its mailing lists, or providing other User services. A User is entitled to and can refuse or delete a cookie. However, such refusal or deletion may prevent a User from properly using the Morphis site's cookie-dependent features.

User Information

Currently, the Morphis site does not require a User to register to access the site for general purposes. However, Users who wish to download software or other products may be required to complete a User Registration form or otherwise provide personal information. Other areas of the Morphis site may require the completion of a User Registration or the provision of personal information in effort to foster open participation in the development of the MORPHIS™ application. Such areas may include, but are not limited to, the Morphis site's mailing lists and bug tracking system.

Use of User Information

Kargo may use User Registration or personal information provided by a User as, for example, a basis for notification, for "opt-in" emails, and to implement the terms of the Terms of Service governing the website (the "TOS"), or for other uses not specified herein:

  • Notices
    In order to implement or enforce the Morphis site's TOS, Kargo may use User Registration or personal information to contact a User on an individual basis.

  • Opt-In Emails
    A User's name and email address, as well as any other information a User may provide or is required to provide, may be publicly available on the Morphis site, unless a User elects to "opt-out" of the display of such information.

  • Email Display
    A User may be able to use the Morphis site to send and receive electronic mail to other Users or to a mail list. In such cases, a User's valid email address and real name will be included with such messages. In order to prevent abuse, users may not opt-out of such a display, but may choose to refrain from using said services to transmit an email message.

  • Other Disclosures
    Where a User has voluntarily and publicly disclosed User Registration or personal information or has otherwise posted User Registration or personal information to conform to the requirements of an open source license, such information may necessarily be disclosed subject to the terms of the applicable license. Such a disclosure could be, but is not limited to, a User's disclosure of personal information as part of a message posted to a public message forum or a publicly released software application.

Kargo will respect the registration information that its Users give. At no time, unless such disclosure is necessary to comply with applicable laws, legal process or to enforce this Agreement, or a User specifically authorizes such disclosure, will Kargo disclose user Registration or personal information that is not publicly available to unrelated third parties. If Kargo requests demographic information from its Users, it will only share aggregate, not individual, information with third parties.

Purpose of User Information

If a User chooses not to register and provide personal information, s/he can still visit most of the Morphis site, however, such Users will not have access to those areas or products that require registration. In particular, non-registered Users may not be able to download or use Kargo's software products.

Changes to User Registration and Personal Information

To help Kargo maintain the accuracy of User Registration and personal information, it asks that Users notify it of any address, title, phone number, or e-mail address changes. If at any time a User wishes to update information or stop receiving communications from Kargo, its partners, or selected third parties, the User may contact Kargo by e-mail at support@morphis.org or by mail at:
