TRADEMARK GUIDELINES FOR MORPHIS.ORG
These Trademark Guidelines are intended for both Users of the Morphis.org website (the "Morphis site") and consumers of the MORPHIS™ application software.
Kargo Trademarks
KARGO™ ; MORPHIS™ ; WAX™ ; the Kargo Logo ™ ; the Morphis Logo™ ; and the Wax Logo™ (hereinafter the "Kargo Trademarks") are trademarks of Kargo, Inc. Kargo has the exclusive right to use the Kargo Trademarks in connection with its goods and services. No one else may use the Kargo Trademarks, or any colorable imitations, in connection with the sale or promotion of any product or service without the prior written permission of Kargo. The Kargo Trademarks may never be used in a manner that is likely to cause confusion among consumers or in a manner that disparages or discredits Kargo.
Kargo Trademarks and the GPL
Pursuant to the terms of the GPL, Users of the Morphis site may freely download, copy, modify and distribute the MORPHIS™ software application. However, the GPL does not give Users the right to use the MORPHIS™ trademark or any of the other Kargo Trademarks in connection with the distribution or marketing of any downloaded, copied, or modified version of the MORPHIS™ software or other derived work. Users must therefore choose another name or trademark for the software they copy or derive from the Morphis site that will not cause confusion with the Kargo Trademarks, and will not indicate or imply that their products originate from or are sponsored or approved by Kargo.Users may state that their product "contains Morphis™ software" or "contains Morphis™ software by Kargo™" but Users must do so in a fashion that indicates that "Morphis" and "Kargo" are not the names or brands of their products and that Kargo is not a source or sponsor of their products.
Kargo encourages Users to employ a trademark statement on all packaging, software, and marketing and promotional material relating to User's copied or derived products such as: "MORPHIS™ is a trademark of Kargo, Inc. This product is not a product of Kargo, Inc. and is not endorsed by Kargo, Inc."
